Collected the new battery from FKs this morning, its an Exide battery with BMW parts numbers on it, but cheaper than other exide batteries from other motor factors etc
Do they not come in the white case anymore
Edit: googled it must be like this now

Yep, it's a white battery, similar to the old one, doesn't seem as good quality as the original, handles are flimsy compared to the old one...not bothered mind you, hopefully wont have to replace it for another 12 years! :)
OEM Batteries are White for Lead Acid & Black for AGM. They are Exide batteries at the minute, they may have been Bosch in the past. A bit like the switch to Sheel for the "official" oil now, used to be Castrol up to Christmas. BMW won't cover warranty work on cars that get Castrol oil in the dealer anymore apparently.

Thanks for that rebel...just another thought...the new battery didnt seem to ave anywhere for the vent tube to attach to. Should i be worried about that?
