Not quite .

The piece says that a solicitor has a number of clients that have had the problem and some that BMW had denied goodwill to but settled with before getting to court. Reading between the lines, the solicitor is looking for a disgruntled customer that will effectively underwrite a trip to court so that they can get a ruling that would create a precedent for everyone else. The out of court settlements don't establish any legal facts or hint at how BMW might defend themselves if they got in front of a judge.

This piece is slightly better written than a similar item in the Indo a few weeks ago, but still a little sensationalist and light on fact.
